Terms of Use

These Terms apply to the HOMZY website (homzy.app) and the HOMZY mobile application (iOS and Android).

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you and Homzy Systems Private Limited (CIN: U62099TN2026PTC192964), the operator of the HOMZY platform. By registering, accessing, or using the HOMZY website or mobile application, you agree to these Terms and our Privacy Policy, which is incorporated by reference.

If you are using HOMZY on behalf of an organisation, company, or builder entity, you represent that you have the authority to bind that entity to these Terms.

2. Who may use HOMZY

• You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher.
• You must be legally capable of entering into a binding contract under applicable Indian law.
• You must not be prohibited from using the platform under any applicable law or regulation.
• You must provide accurate and complete information during registration and while using the platform.

3. HOMZY's role as a technology platform

All decisions, negotiations, legal due diligence, and transactions are entirely between the users involved. HOMZY has no role in, and accepts no responsibility for, the outcome of any property transaction facilitated through the platform.

4. No endorsement or builder promotion

5. Account registration and security

• You must provide accurate, complete, and current information during account registration.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must notify us immediately at hello@homzy.app if you suspect unauthorised access to your account.
• You may not create multiple accounts for the same individual or entity without our prior written consent.
• You may not transfer your account to another person or entity.
• HOMZY reserves the right to verify your identity, phone number, or listed property at any time.

6. Property discovery and connection services

HOMZY helps users discover property listings that may fit their stated intent, preferences, location, and budget. Our platform enables users who share a mutual interest in a property to initiate private in-app communication before exchanging personal contact details.

HOMZY does not guarantee that any listing shown to you will meet all your requirements, be available, or result in a successful property transaction. HOMZY does not guarantee any number of views, connections, chats, leads, visits, negotiations, conversions, rentals, sales, or revenue from any listing, subscription, or paid feature.

7. Listings and user content

7.1 Listing responsibility

By submitting a listing, you represent and warrant that:

• You are the owner of the property or have the legal authority to list it.
• All information, photos, and documents you submit are accurate, complete, and not misleading.
• The property is available for the transaction type stated (sale or rent).
• You will update or remove the listing promptly if the property becomes unavailable, sold, or rented.
• The listing complies with all applicable laws, including RERA where applicable.
• You hold all necessary rights and permissions to share the photos and documents you upload.

7.2 HOMZY's content rights

By submitting listing content, photos, or other materials to HOMZY, you grant Homzy Systems Private Limited a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use that content within the HOMZY platform for the purpose of operating the service. This licence ends when you remove the content or close your account, except where limited copies are retained in backups, audit logs, safety records, or legal records.

HOMZY reserves the right to review, moderate, edit, or remove any listing or content that violates these Terms, is suspected to be fraudulent, or is otherwise harmful to users or the platform.

8. Builder and project listings

• Project information including pricing, configuration, floor plans, amenities, possession dates, and RERA registration numbers must be accurate at the time of listing.
• Where RERA registration is required under applicable law, the relevant RERA number must be disclosed in the listing.
• Any changes to project status, pricing, or possession timelines must be updated on the platform promptly.
• HOMZY is not responsible for verifying the legal status, approvals, or financial position of any builder or project listed on the platform.

9. User responsibilities

• Using the platform only for lawful purposes and in good faith.
• Providing accurate information in their profiles, listings, and requirements.
• Treating other users respectfully in all in-app communications.
• Not using the platform to harass, defraud, deceive, or harm other users.
• Not attempting to circumvent HOMZY's systems, security measures, or policies.
• Complying with all applicable Indian laws and regulations, including those relating to property transactions, consumer protection, and data protection.

10. Buyer and tenant due diligence

Users seeking to buy, rent, or lease a property through HOMZY are solely responsible for their own independent due diligence, including:

• Verifying the ownership, title, and legal status of the property.
• Checking for encumbrances, mortgages, litigation, or disputes on the property.
• Verifying RERA registration where applicable under state laws.
• Confirming the accuracy of property dimensions, amenities, and condition through physical inspection.
• Understanding applicable taxes, stamp duty, registration charges, and other transaction costs.
• Seeking independent legal, financial, and technical advice before concluding any transaction.

HOMZY strongly recommends that you engage a qualified property lawyer and, where applicable, a RERA-registered broker before finalising any property transaction.

11. Verification disclaimer

HOMZY may apply verification indicators, trust scores, or confidence ratings to listings based on our internal review processes. These indicators are intended to improve user experience and do not constitute a guarantee of the accuracy, legal compliance, authenticity, or suitability of any listing or user.

A "Verified" badge on HOMZY means only that the listing passed our internal content review process at the time of verification. It does not mean HOMZY has verified legal title, ownership documents, regulatory compliance, physical condition, or any other aspect of the property. Trust scores and verification badges are not paid endorsements.

12. Listing enforcement

HOMZY may remove, hide, downgrade, restrict, or mark any listing as suspicious if it appears inaccurate, duplicate, misleading, unavailable, fraudulent, non-compliant with RERA, or harmful to users. HOMZY may request supporting documents before restoring a listing that has been restricted.

Repeated submission of inaccurate or fraudulent listings may result in account suspension or permanent removal.

13. In-app messaging and calls

• You will use in-app communication only for genuine property-related discussions.
• You will not use chat or calls to share abusive, threatening, offensive, discriminatory, or illegal content.
• You will not use in-app communication to spam, solicit, or send unsolicited commercial messages.
• You will not use chat or calls to conduct or facilitate fraudulent schemes, impersonation, or property scams.
• You will not ask other users to continue property conversations outside HOMZY to circumvent the platform's safety features.
• You will not record audio calls without the knowledge and consent of all parties, where such recording is restricted by applicable law.
• HOMZY may review messages or conversation records reported for abuse, fraud, or policy violations.

You should never share sensitive financial details, bank account numbers, UPI IDs, passwords, or payment credentials through HOMZY's messaging system.

14. Payments, subscriptions, and refunds

• Pricing, billing cycle, included features, and applicable taxes will be displayed clearly before you make a purchase.
• Payments are processed securely through Razorpay. HOMZY does not store your payment credentials.
• Subscriptions are activated upon successful payment confirmation.
• Once a paid subscription, listing package, verification service, or premium feature is activated, the fee is non-refundable unless required by law or expressly stated at checkout.
• If a user is charged but the paid service is not activated due to a HOMZY technical error, HOMZY will either activate the service or issue a refund.
• In case of duplicate payment, failed transaction, or incorrect charge confirmed by HOMZY or Razorpay, the eligible amount will be refunded to the original payment method within 7–10 working days.
• You may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period and paid features remain accessible until that date.
• Payment gateway charges, taxes, platform convenience fees, and already-consumed service periods may be non-refundable unless the refund is due to HOMZY's error or required by law.
• No refund will be provided if the account, listing, or subscription is suspended or terminated due to fraud, fake listings, forged documents, abusive conduct, policy violation, unlawful activity, or misuse of the platform.
• HOMZY does not guarantee views, connections, chats, leads, site visits, rentals, sales, or transactions. Lack of response or an unsuccessful property transaction will not by itself qualify for a refund.
• Refund requests must be raised within 7 days from the charge date by emailing hello@homzy.app with your transaction ID, registered mobile/email, payment date, and reason.
• If HOMZY uses Apple App Store or Google Play in-app purchases, such payments may be subject to the refund policies of the respective app store. HOMZY may not be able to directly process such refunds.

15. Prohibited conduct

• Post false, misleading, duplicate, or non-existent property listings.
• Impersonate another person, user, owner, builder, or HOMZY employee.
• Submit forged, altered, or fraudulent ownership documents or identity information.
• Scrape, crawl, or extract listing data, user data, or any content from the platform without our written permission.
• Use automated bots, scripts, or other tools to access or interact with the platform.
• Attempt to reverse engineer, decompile, or access the source code or backend systems of HOMZY.
• Interfere with, disrupt, or damage the platform's infrastructure, servers, or security systems.
• Post content that is defamatory, obscene, pornographic, racist, or otherwise unlawful.
• Use the platform for any purpose that violates applicable Indian law, including the IT Act 2000, the DPDPA, consumer protection laws, or RERA.
• Collect or store personal data of other users without their explicit consent.
• Use the platform to advertise services unrelated to legitimate property discovery and transactions.

16. Fraud and abuse reporting

Users may report fake listings, fraud, impersonation, abusive conduct, or suspicious activity through in-app reporting or by emailing hello@homzy.app or privacy@homzy.app. HOMZY will review reports and may take action including listing removal, account restriction, account suspension, or reporting to lawful authorities where required.

17. Intellectual property

All content, design, software, trademarks, logos, brand names, visual elements, and technology on the HOMZY platform — including the HOMZY name and HOMZY™ mark — are the property of Homzy Systems Private Limited or its licensors and are protected under applicable Indian intellectual property laws.

You may not reproduce, distribute, publicly display, modify, create derivative works from, or otherwise use any part of the HOMZY platform, its content, or its branding without our prior written permission, except as expressly permitted by these Terms.

The HOMZY trademark is pending registration. All rights are reserved.

18. Third-party services

HOMZY integrates with third-party services including Google Maps, Razorpay, MSG91, and others to deliver its features. These third-party services are governed by their own terms and privacy policies, which we encourage you to review.

Third-party service providers integrated with HOMZY are independent service providers and are not employees, agents, partners, or representatives of HOMZY. HOMZY is not responsible for their independent acts, omissions, service quality, downtime, or policies, except as required by applicable law.

HOMZY may contain links to external websites or platforms. These links are provided for convenience only and do not constitute an endorsement. HOMZY has no control over external content and accepts no liability for it.

19. Suspension and termination

HOMZY reserves the right to suspend, restrict, or permanently remove your account, listings, messages, or access to any feature of the platform at its sole discretion, with or without notice, if we reasonably believe you have violated these Terms, submitted fraudulent or misleading information, harassed or defrauded other users, or used the platform for unlawful purposes.

You may close your account at any time by contacting us at hello@homzy.app or using Settings → Account → Delete Account in the app. Upon account closure, your active listings will be removed and your account data will be retained and then deleted in accordance with our Privacy Policy.

20. Disclaimers

The HOMZY platform and all content, listings, and services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

• We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or harmful components.
• We do not warrant the accuracy, completeness, legality, or suitability of any property listing, user profile, or content on the platform.
• We do not guarantee that any property transaction initiated through the platform will be completed, or that any property will be available, priced as listed, or legally clear.
• HOMZY does not provide legal, financial, investment, or tax advice. Any information on the platform is for general informational purposes only.

21. Limitation of liability

To the maximum extent permitted by applicable Indian law, Homzy Systems Private Limited and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, any loss of property, financial loss, investment loss, listing inaccuracies submitted by third parties, platform interruptions or downtime, or unauthorised account access resulting from failure to maintain account security.

Where liability cannot be excluded by law, our total aggregate liability shall not exceed the greater of the amount you paid to HOMZY in the 3 months immediately preceding the event giving rise to the claim, or INR 1,000.

22. Indemnity

You agree to indemnify, defend, and hold harmless Homzy Systems Private Limited and its directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the HOMZY platform, your violation of these Terms, any content or listing you submit, or your violation of any applicable law or the rights of another person.

23. Changes to services and terms

HOMZY is an evolving product. We reserve the right to modify, suspend, or discontinue any feature, service, or part of the platform at any time with reasonable notice where practicable. We may update these Terms from time to time and will notify you of material changes by updating the "Last updated" date and, for significant changes, sending a notice to your registered email or through the app. Continued use of HOMZY after a change is posted constitutes acceptance of the updated Terms.

24. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the use of the HOMZY platform shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.

Before initiating formal legal proceedings, we encourage you to contact us at hello@homzy.app to resolve disputes informally. We will make reasonable efforts to resolve concerns within 15 working days.
